Last night at 1 a.m. I recieved a ticket in Pembroke Pines for doing 61 in a 40. The officer said he used radar and what not. Heres what I don't get though, I was looking up the violation he wrote on the ticket and I dont think its correct.
http://www.flsenate.gov/Statutes/in...&Search_String=&URL=Ch0316/SEC189.HTM&Title=->2004->Ch0316->Section%20189#0316.189

That is the link for the statue he cited me on 316.189 (1)

If theres anyone knowledgeable in this area your help would be greatly appreciated. As this my first ticket and I have a goal of not getting any until I am nineteen, four more months was all I needed but oh well I was breaking the law.

Also on the green paper that tell you how to pay the ticket, stated that if I pay the reduced fine and agree to take a four hour class. I would maintain my safe driver record, no points would be acessed and most importantly my insurance premium would not be affected in any way. Someone please correct me if I misunderstood the information.

That statute is a little strange. There is a number of ways to go with this.
1. Take the ticket to a traffic lawyer and have him look at it and look up the statute. If it is incorrect then thats an easy dismissal.
2. Pay the fine at the reduced rate with the 4 hour course and you will not be given any points....the insurance part Im not sure of.
3. Go to the courthouse and say you want to take it to court. You will be given a court date (6-8 weeks later). At that date you will be given the option of changing your plea. By changing it to 'No contest' it will be taken care of right there and then. Draw back to this is the decision is based soley on the judge that is there.....so hope he/she is having a good day. Being that it is your first offense chances are the fine you'll be given will be significantly less than paying the actual fine and you will not be given any points or driving school....(sometimes).
4. Wait till you start getting all those mailers from lawyers...(ticket clinic type stuff) and pick one and have them deal with it. This saves you the hassle of going to court and having to do driving school.

Good luck with it.

I done all the above,
1) pay the ticket and problem solve, Points will be deducted
2) I done the course and payment is supposed to be less because of the couse but no pouints taken out
3) last time I decided to say i didn't speed at all and the judge went in my favor and I didn't pay a cent. Of couse i was very polite with both the cop and the judge also I never saw the Speedometer in the police car wich by law is supposed to be show to the driver in PR.

If I where you take it to court using a Layer its your desition, Sometimes a layer will agree not to charge you if you are guilty and if he can dismiss the ticket will chrg you less. So you end up with less money to pay.

good luck and sorry for the spelling...Not in the mood for corrections today!

I always like a good layer in my bed....

your best bet is to get a lawyer... or take the traffic school.... but whatever you do, don't just pay the ticket...

and you don't have a radar detector?

go to court on the date specified and tell the judge you would like "adjudication to be witheld". you pay court costs (if that) and your done. no points, no nothing. if this is your first offense ever then the judge will most likely withold adjudication. or if you haven't had a ticket in the last 3 years or so. basically what it means is that your not saying your guilty, but your not saying your innocent neither.
you pretty much have to have a clean record to get it.

as far as the class is concerned, you can only take it 1 time in a 12 month period and only 5 times in your lifetime. i took the class when i got a 118 in a 55. i figure i'll save it for my big tickets like that one. i only got 4 more left and i'm only 29 :D

I got issued a ticket a little while ago used the online school:
http://www.floridaonlinetrafficschool.com

Okay it takes litterly 20 minutes of YOUR time. If you have common sense you can just skip to the quiz at the bottom of every page if you pass (it doesnt hurt if you fail only the final counts) just leave the page open and browse SF, look at porn whatever, to kill time, then go to the next section. Each section has a minimum you have to spend, no click needed just sit there and let the clock run!

anyways pasted with 2 wrong answers.... don't get me wrong i am a smart guy :D but anyone whos has common sense should have no problem.

Good luck!

Thanks for all of the advice. I think I'm going to avoid going to face the judge although thats the route that has been suggested the most. I don't have good luck as it is and I don't want to put everything in the fate of a judge who might be having a bad day. I'm going to give one of those ticket lawyers and see what they can do for me. Then I'm going to size up the cost factor of paying the lawyer to handle everything vs. paying the reduced fine and traffic school.(money is kinda tight right now)

Supradedupra: When I had the Supra I was going to invest in a V1, but I sold the supra and decided to get a stock slow car (to keep me out shit like this). To be honest with you, if you ever see me in the integra I'm doing the speed limit except in the wee hours when the roads are empty.

Thanks again for all of your help.
